Release of Claims: Participant hereby releases Automotive Packaging Summit (APS) from any and all liability or claims which may arise from participation in the Event. This paragraph shall be inclusive of, but not limited to, any injury or death resulting from consumption/exposure to food or beverage allergies, food borne illnesses, theft of or damage to Participants’ property, transportation or commute, exposure to adverse weather conditions, or choking. Participant, on behalf of Participant and Participant’s successors, agents or assigns, hereby forever and unconditionally releases APS, its owners, employees, agents, successors in interest and insurers (hereinafter referred to as the “Released Entities”), from any and all claims, actions, damages, liabilities, losses, costs, and expenses, including, without limitation, attorney’s fees, in any way arising out of, or resulting from, Participant’s participation in the Event. Any liability found on the part of APS shall be limited to the cost of participation. Participant further acknowledges that APS is in no way liable for any injury to participant resulting from Participant’s own conduct or behavior or that of other guests.
Consumption of Alcohol: Participants twenty-one (21) years of age and older are able to drink alcohol during designated times at the Event should they choose to do so. However, alcohol consumption shall be at Participant’s own discretion, risk and liability. APS reserves the right to excuse any Participant from the Events if said Participant becomes inebriated and misbehaves or has the potential to cause harm to him or herself or any other person or persons. If a Participant is excused from the Event pursuant to this paragraph, it shall be without any sort of reimbursement by APS. All Participants hereby assume all risk involved with the consumption of alcohol and unconditionally hold APS harmless.
Promotional Release: Participant hereby grants Automotive Packaging Summit a worldwide, royalty-free irrevocable license to use Participant’s photographic, video, or digital likeness for promotional, educational, and/or commercial purposes. This Paragraph shall, however, be limited to pictures, videos and descriptions of events which are captured in the course of the Event, or within a reasonable time thereof.
Binding Effect: Participant acknowledges that this Agreement shall be binding upon Participant’s heirs and assigns, personal representatives, beneficiaries and next of kin. Participant acknowledges that he or she has carefully read this Agreement and submits to all of the foregoing provisions. Further, Participant acknowledges that he or she enters into this Agreement under his or her own volition, and that Participant has been afforded the opportunity to review this Agreement with the attorney of his or her own choosing. Participant acknowledges that he or she is giving up substantial rights by agreeing to the provisions of this Agreement.
COVID-19/Contagious Illness: Participant understands, acknowledges and assumes the risks and dangers associated with participation in attending the event, including without limitation, the potential for serious bodily injury, sickness and disease (including COVID-19); situations unknown to or beyond the immediate control of the Event Organizers; and other undefined, not readily foreseeable and presently unknown risks and dangers ("Risks"). COVID-19 is an extremely contagious disease that can lead to severe illness and death. According to the S.C. Department of Health and Environmental Control, persons 65 years of age and older and persons with underlying medical conditions are especially vulnerable. By visiting AutoPack Summit you voluntarily assume all risks related to exposure to COVID-19 and/or any other contagious illness.
Logos: Trademarks, service marks, and logos appearing in this website are the property of APS or the party that provided the trademarks, service marks, and logos to APS. APS and any party that provided trademarks, service marks, and logos to APS retain all rights with respect to any of their respective trademarks, service marks, and logos appearing in this site. Unauthorized use of the trademarks, service marks and logos of APS or any third party is unlawful and will be grounds for exclusion from future use of this website.
Changes and Cancellations: Although APS’s Event programs are correct at the time of publication, we may in exceptional circumstances need to cancel or postpone an Event, in which case we shall notify you as soon as reasonably practicable. In the event of cancellation, we shall issue Participants with a full refund of relevant Fees paid by you. In the event of postponement, we shall offer you the option to re-register for the rescheduled Event or, issue you a full refund of relevant Fees paid by you. Our liability to you as a result of any cancellation or postponement of an Event shall be limited to the amount of Fees which you have paid to us for that Event only and we shall not be liable for any additional Losses incurred by you as a result of such cancellation or postponement.
Cancellation by Attendee: APS registrations are non-refundable. If you are unable to attend, your registration can be transferred to another employee of your company at no additional fee. Please email Bianca@packaginschool.com for transfer requests, questions or concerns.
Force Majeure: A In this clause, “Force Majeure” means circumstances which are beyond our reasonable control and which are reasonably likely to affect the successful delivery of the Event or would make it inadvisable, impracticable, illegal, or impossible for us to host the Event or perform our obligations under these Terms, including circumstances, which directly affect the Participants in their home countries resulting in a material percentage of the Participants being reasonably likely to be prevented from attending the Event.
If, as a result of Force Majeure, APS cancels the Event, APS shall use its reasonable endeavors to either (a) reschedule the Event; or (b) switch the Event from a physical Event to an Online Event.
If APS is unable to reschedule the Event, it shall refund the Participant Fees as soon as reasonably practicable and in any event within 90 days from the date of notice of cancellation.
Without prejudice to APS’s obligation to refund any Fees to Participants, APS accepts no liability and shall pay no compensation where the performance of its obligations is made impracticable, illegal or impossible by or as a result of Force Majeure.
Changes to Event: Although Automotive Packaging Summit’s Event programs are correct at the time of publication, we may exchange the format, Content, venue, speakers, hosts, moderators and/or timing of an Event, including a change from a physical Event to an Online Event. APS shall use its reasonable endeavors to notify all Participants of any such changes prior to an Event.
Limitation of liability: Nothing in these Terms shall limit or exclude our liability for:
Speaker Release: Speaker hereby grants to APS the right to use his or her name, voice, appearance, likeness, image, words, participation and title or professional designation, and company logo in whole or in part, in these recordings and/or compilations and in any correspondence, publicity, advertising, promotional or other derivative materials based on them. AutoPack Summit has no obligation to make use of the rights granted herein.
Speaker hereby grants APS the unconditional and irrevocable right to reproduce the recording in any format, and to distribute, sell, prepare, derivative works, advertise, and publicize the recordings without compensation to the Speaker. AutoPack Summit may edit the recordings at our discretion.
Antitrust Compliance Statement: AutoPack Summit, its parent and affiliates are committed to strict compliance with antitrust laws. It is important that everyone in attendance refrain from activity that risks violation of those laws or that raises the appearance of impropriety. At this event, speakers and attendees may provide highly sensitive information about its products and services to its business partners or other participants; however, that information is not to be shared with competitors or other industry participants. In addition to maintaining the confidentiality of participants’ information, you must not discuss or exchange the following types of non-public information, whether pertaining to OEM competitors or to you and your competitors, during or after this event:
The disclosure of the types of information above risks violation of antitrust laws and could result in severe civil and criminal penalties for companies and individuals. If you believe that any discussions may raise antitrust concerns, please stop those discussions and have the matter brought to the attention of AutoPack Summit’s coordinators. AutoPack Summit is committed that its events shall not be used for the purpose of bringing about any anticompetitive agreement or unfair methods of competition.

Consequences of Unacceptable Behavior: Unacceptable behavior will not be tolerated and could result in expulsion from APS and/or any future APS events. If you are found or reasonably believed to be engaging in unacceptable behavior, APS may take any action it deems appropriate, up to and including expulsion from APS without warning or refund. If necessary, local law enforcement may need to become involved. APS has zero-tolerance for any form of discrimination or harassment, including but not limited to sexual harassment by participants or our staff at our meetings. Entering Booth: By entering an exhibit booth and allowing your badge to be scanned, you are providing the exhibitor with your contact information and opting-in to receive communications from the exhibitor. You will be subject to their communications and privacy policy and must opt-out with them directly if you choose not to receive communications.
Partner Registrations: I understand that the intent of this registration is for the sole purpose of education and networking with fellow attendees. An intent of doing business with attendees is limited to the companies and company members registered as a part of a sponsorship and/or exhibiting agreement directly with APS. All partnering companies that are interested in sponsoring or exhibiting with APS should please contact Bianca@packagingschool.com. I understand that if I am a partnering company and I’m not participating through a partnership agreement, my registration can be revoked without refund.
Liability Waiver and Release: In consideration of being allowed to register for and participate in APS, you hereby represent that you are 18 or above and freely waive, release from liability, assume all risks, and covenant not to sue APS or its employees, or volunteers for any expense, loss, damage, personal injury, including loss of life, illness, disability, property damage, or property theft or actions of any kind that you may hereafter suffer or sustain before, during, or after APS, unless said expense, loss, damage, personal injury, including loss of life, illness, disability, property damage or property theft or actions of any kind is caused by the gross negligence of APS. This Liability Waiver and Release is binding on your heirs and assigns.
Data Privacy: As part of your registration of APS, APS may share the data you provide APS with third party vendors, to make you aware of goods and services you may be interested in, to perform analytics, and in connection with APS and for such other purposes as APS may approve from time to time. Your registration may include technology that monitors your activities throughout APS, such as session attendance and booths visited.
General: APS reserves the right to change, amend, add or remove any of these Terms and Conditions in its sole discretion and without prior notice. If one or more of the conditions outlined in these Terms and Conditions should become invalid, the remaining will continue to be valid and apply. These Terms and Conditions apply to all APS participants (attendees, speakers, sponsors, exhibitors, etc.). The views expressed by any attendee, speaker, exhibitor, or sponsor are not necessarily those of APS. All attendees, speakers, exhibitors, and sponsors are solely responsible for the content of all individual or corporate presentations, marketing collateral, and/or advertising.
Entire Agreement: This Agreement contains the entire agreement of the parties and there are no other promises or conditions in any other agreement whether oral or written. This Agreement supersedes any prior written or oral agreements between the parties.
Severability: If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.
Use of Logo: Participant hereby grants to APS the express right to use Participant's company logo in marketing, sales, financial, and public relations materials and other communications solely to identify Participant as an attendee/speaker of APS. APS hereby grants to Participant the express right to use APS’s logo solely to identify APS as a provider of events and education to Participant. Other than as expressly stated herein, neither party shall use the other party's marks, codes, drawings or specifications without the prior written permission of the other party.
Waiver of Contractual Right: The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Agreement.
Applicable Law: This Agreement shall be governed by the laws of the State of South Carolina.
